The Australian Skills Quality Authority (“ASQA”) regulates the vocational and educational training (“VET”) sector nationwide.
ASQA’s role extends to the registration and accreditation of VET providers (known as Registered Training Organisations (“RTOs”)) and the programs offered by the RTOs.
ASQA prescribes a set of standards known as the VET Quality Framework, which must be adhered to in order to be registered as a RTO and to maintain this registration. The VET Quality Framework includes some of the following requirements:
- Fit and Proper Person Requirements;
- Financial Viability Risk Assessment Requirements;
- Data Provision Requirements; and
- Payment of applicable fees.
ASQA also manages training for overseas students by:
- Registering courses on the Commonwealth Register of Institutions & Courses for overseas students;
- Ensuring licensing requirements are satisfied.
If ASQA becomes aware of non-compliance by a RTO, ASQA has the power to sanction the RTO or impose additional conditions on the registration of the RTO.
If you are an RTO and are in dispute with ASQA as to your registration and/or the VET programs offered, we recommend that you contact our firm on (02) 9233 4048 or send an email to info@navado.com.au and arrange an appointment to see one of our Compliance & Regulatory Law Solicitors.
