Assault occurs when a person intentionally or recklessly causes another person to fear immediate violence. It can be through words or actions. There are different categories of assault prescribed by law, some of which also deal with circumstances where a person is injured in the course of the assault. They include:-

  • common assault
  • assault occasioning actual bodily harm
  • assault occasioning grievous bodily harm
  • reckless wounding
  • assault against police officers

There are also some very specific types of assaults, such as:

  • obstructing member of the clergy in discharge of his or her duties
  • assault on persons preserving wreck
  • assaults at schools

Common assault is the least serious of all the assault offences. It is an offence which carries a maximum imprisonment of 2 years. Common assault is the most basic form of assault and does not involve any actual physical harm.

Assault occasioning actual bodily harm is an assault which causes actual harm which is more than transient and trifling, but need not be permanent. Emotional harm does not suffice unless there is evidence of psychiatric harm or an identifiable clinical condition.

Assault occasioning grievous bodily harm is an assault which causes bodily harm of a serious kind. This is not limited to injuries which cause disfigurement.
