A Financial Manager, also known as a Property Manager or Estate Manager, may be appointed to manage a person’s financial affairs. Generally, a Financial Manager will be appointed in circumstances where there is a dispute between family members and/or care-givers regarding the financial affairs of an incapable individual, where that incapable individual may need to engage in legal proceedings and require a Financial Manager to sign documents on their behalf.

The Guardianship Act 1987 and NSW Trustee and Guardian Act 2009 authorise the Guardianship Division of NCAT to make Financial Management Orders in such matters.

In some instances, you may believe that a person(s) who has been appointed as Financial Manager may be unsuitable and may not be able to fulfil the Financial Managers’ responsibilities. Therefore, if you have a genuine concern for the welfare and financial status of the protected person, you may be able to apply for the Review or Revocation of a Financial Management.
